Apparel (hereinafter referred to as the "e-shop") on the website www.novavitas.co.za, operated by MINDSHIFTERS Ministries, company ID 2025/034737/08, based in 135 Bellairs Drive, Nortriding, processes personal data provided by the Customer to fulfill and confirm the Terms and Conditions, to process electronic orders and shipments, and for the necessary communication during the period required by law.

1. General Provisions

  1. The personal data controller, in compliance with OPIA (hereinafter referred to as "Regulation"), is hyperLOOP, company ID 2014/198289/07, based in 135 Bellairs Drive, Northriding (hereinafter referred to as the "Controller").

  3. Personal data is any information that relates to an identified or identifiable natural person.

2. Source of Personal Data

  1. The Controller processes personal data obtained with the Customer's consent and collected through the contract to purchase and the fulfillment of electronic orders created in the e-shop.

  2. The Controller processes only the identifying and contact details of the Customer which are necessary for the fulfillment of the purchase contract.

  3. The Controller processes personal data for shipping, accounting purposes, and the necessary communication between the contracting parties for the duration required by law. Personal data will not be made public and will not be transferred outside the required jurisdictions without compliance.

3. Purpose of Data Processing

The Controller processes personal data of the Customer for the following purposes:

  1. Registration on the website www.novavitas.co.za in compliance with Chapter 4, Section 2 of GDPR.

  2. Fulfillment of the electronic order created by the Customer (name, address, email, telephone number).

  3. Compliance with legal obligations and regulations arising from the contractual relationship between the Customer and Controller.

  4. Since personal data is necessary for the fulfillment of the purchase contract, the contract cannot be concluded without this data.

4. Duration of Personal Data Storage

  1. The Controller stores personal data for the period necessary to fulfill the rights and obligations arising from the contractual relationship between the Controller and the Customer, and for 3 years following the conclusion of the contractual relationship.

  2. The Controller will delete all personal data after the expiration of the legally required storage period.

5. Recipients and Processors of Personal Data

Third parties processing personal data of the Customer are subcontractors of the Controller. Their services are indispensable for the successful fulfillment of the purchase contract and the processing of electronic orders between Controller and Customer.

Subcontractors of the Controller include:

  • Webnode AG (e-shop system)

  • Shipping companies (for delivery services)

  • Google Analytics (for website analytics)

6. Rights of the Customer

In compliance with the Regulation, the Customer is entitled to:

  1. The right of access to personal data.

  2. The right to rectification of personal data.

  3. The right to erasure of personal data.

  4. The right to object to the processing of personal data.

  5. The right to data portability.

  6. The right to withdraw consent to the processing of personal data in writing or by email sent to info@novavitas.co.za.

  7. The right to lodge a complaint with the supervisory authority in case of suspected breach of the Regulation.

7. Security of Personal Data

  1. The Controller declares to take all technical and organisational precautions necessary for the protection of personal data.

  2. The Controller has implemented appropriate security measures, including:

    • Securing access to computers with passwords,

    • Use of antivirus software,

    • Regular system and data maintenance.

8. Final Provisions

  1. By placing an electronic order on the website www.novavitas.co.za, the Customer confirms being informed about all the conditions of personal data protection and accepts them in full.

  2. The Customer accepts these rules by ticking the consent checkbox in the order purchase form.

  3. The Controller may update these rules at any time. A new, updated version must be published on the website.

These Rules come into effect on 20 August 2025.
